Dear J/105 Owner:
Your Technical and Executive Committees ask that you give serious consideration to the proposals to change the class constitution and to make certain changes to the class rules set forth below.
For your convenience, Nelson will
add a link on the website to a document which contains the constitution and
rules as proposed to be revised, showing all proposed additions as underlines
and all proposed deletions as strikethrough.

CHANGES TO THE CLASS CONSTITUTION

Replace the Class
Constitution to read in full as attached hereto as Schedule 1
Discussion: This submission makes numerous changes to the Class Constitution. The following is a description of the more significant ones:
¯ The proposal changes the number of votes held by fleet representatives on the Executive Committee to more closely approximate a "one man, one vote" concept. Under the current Constitution, a fleet representative has one vote plus one additional vote for each complete 20 boats registered in the fleet and the "at large" representative has one vote. Under the proposal, a fleet representative has one vote for each 10 boats registered in his or her fleet and the "at large" representative has one vote for each 10 boats owned by Class Association members not registered in any other fleet. The Copyright Holder, the President, the Vice-President, the Secretary/Treasurer, the At-Large Representative and the Chief Measurer will each retain one vote, as under the current Constitution. This change is being proposed in response to a request from Fleet 6 to go to a "one man, one vote" system. The "one man, one vote" proposal was hotly debated at the June 3, 2002 and October 21, 2002 meetings of the ExComm and the proposal represents a compromise that the ExComm as a whole endorses.
¯ The proposal imposes certain additional procedures on changes to the "Specifications" of the J105 which are made by TPI and other builders of the J105. ÒSpecificationsÓ means (i) design of hull, deck, keel, rudder, sail plan, spars, equipment, and interior of the J105, and (ii) the manufacturing processes, techniques, hardware, equipment, furnishings and materials used in the construction of the J/105. Under the proposal, generally, all changes to the Specifications require 30 days prior notice to the TC. This is designed to give the TC time to determine whether the change is a "Performance Affecting Change," which will require the same ExComm vote and owner consent/consensus as any change to the class rules. ÒPerformance Affecting ChangesÓ are defined to include any changes to the shape, dimensions, weight, weight distribution, and rigidity (stiffness of bending moments) of the hull, deck, interior, keel, rudder, mast and boom that the TC determines to have "more than a negligible effect" on the performance, sailing characteristics and ease of operation of the J105. There is one exception to the prior notice requirement which applies to "insignificant changes" where the giving of prior notice would be "impracticable" and which JBoats determines is not a "Performance Affecting Change."
¯ The quorum for ExComm decisions is increased to 1/2 of the number of members of the ExComm. Under the current Constitution, 5 members of the ExComm constitute a quorum and a simple majority of those five could adopt any change to the class rules.
¯ The current Constitution is ambiguous whether the ExComm has the right to vote down a proposal for a rules change without submitting it to the formal member approval/consensus process. In the past, the ExComm has on occasion decided not to submit a proposal when the ExComm thought that the proposal wasn't a good idea. The proposed revised Constitution is clear that the ExComm has this right, but provides that 20 active members have the right to override the ExComm decision.
¯ The proposal states that changes to the class rules can only be made once a year. The deadline for a proposal to make a change is 9/1 and the effective date of any change is no earlier than 2/1 of the following year. The proposal also adds that the Excomm has the right to make immaterial or non-substantive changes to rule change proposals after the membership vote.
¯ The current Constitution does not permit ExComm voting on rules changes by e-mail, and doesn't clearly permit other votes and notices to be made and given by e-mail, all of which is becoming standard practice of the ExComm. The proposal changes this.
¯ The current Constitution is ambiguous whether the TC has the authority to issue TC rulings without separate ExComm approval. It has been the practice in the past to send copies of proposed "formal" TC rulings to the ExComm to get their input, but traditionally the TC has not obtained formal approval prior to issuance of "formal" rulings and "informal" rulings have been made without prior notice to the ExComm. The proposal clarifies that TC rulings without ExComm approval are permitted (the ExComm can always override the TC after the fact).
¯ Under the current Constitution, there is no 60 day publication requirement and no membership approval/consensus process for changes to the Constitution as there is for changes to the class rules. The proposal conforms the process for changes to the Constitution to that for changes to the Class Rules (except that 2/3 vote of the ExComm is required, rather than majority for class rule changes).
¯ The proposal adds a customary indemnity provision under which the Class would have to indemnify class officers and ExComm members if they were sued in connection with their duties for the class.
¯ There is significant clean up of the terminology to conform to the Class Rules and to avoid undesirable connotations (like in "Active Fleet", which the proposal changes to "Voting Fleet").
Although the current Constitution does not require a
member vote on these changes, the ExComm will not enact these changes unless
they are approved in accordance with the new publication and membership
approval/consent procedures for changes to the Constitution as contained in
this proposal.
CHANGES TO THE CLASS RULES
Submission #2
Revise Exhibits 7.3A and 7.3B to
the Class Rules to read as attached hereto as Schedule 2.
Revise Class Rule 7.3 by adding the following at the end
thereof:
"or his or her designee"
Discussion: The floatation procedure and certificate is being revised and clarified in a number of respects: First, the revised procedure now limits the amount of corrector weight and water ballast that can be added in the center of the boat to 400lbs. If additional weight is needed to float the boat down to the float lines, that weight will have to be added in the forepeak (30%) or aft of the forward end of the cockpit (70%). The ExComm anticipates that only a handful of pre-SCRIMP boats will be subject to this new provision as most pre-SCRIMP boats require less than 400lbs of weight to float correctly. The Technical Committee believes that this change will result in improved equality of the pitching moment of SCRIMP and pre-SCRIMP boats..
Second, the revised procedure clarifies that water and fuel tanks and batteries cannot be moved from their standard locations for the particular interior style of the boat and that the cooler must remain in its standard location while racing. Thus, for example, the batteries for the "traditional" interior (including any second battery) must be located under the forward end of the cockpit and for the "Euro" interior, must be located aft of the engine. These differences in location are designed to balance out differences in the weight distribution between these different interior styles.
Third, the revised procedure clarifies that all items listed in paragraph II of the Worksheet & Certificate under "Checklist of Equipment and other Items Required for Measurement Trim" must be on board at all times while racing. This list is NOT intended as a guideline or rule of minimum safety equipment aboard a J/105. For example, these items do not include all equipment that would be required for ORC category 4 racing, the category applicable to many J/105 regattas pursuant to the notice of race or sailing instructions. In any event, the responsibility for providing and maintaining a safe and seaworthy vessel rests entirely on the owner and skipper. Neither the establishment or use of this Checklist, nor the inspection of a boat for compliance with the Checklist in any way limits or reduces the complete and unlimited responsibility of the owner or skipper.
Fourth, the revised procedure permits the Worksheet and Certificate to be signed by designees of a fleet measurer. This should make it easier for fleet measurers to handle the significant number of required measurements. Lastly, the revised procedure clarifies the treatment of optional items that are permanently installed on the boat at measurement trim, such as items that are included in the optional "Systems Group" (water tank, etc). It also permits corrector weights to be glued in place (such as with "5200"). The current procedure only permits bolting or glassing in of corrector weight.

Add the following rule 7.9:
"7.9 While racing, the standing rigging (other than the back stay) and the location of the mast butt shall not be adjusted. "
Replace the following language
in rule 7.7: "infringing rule 7.2, 7.5 or 7.6" with the following:
"infringing rule 7.2, 7.5, 7.6 or 7.9"
Discussion: The existing class rules and RRS do not restrict the adjustment of the standing rigging or mast butt position while racing or between races. See RI 99-10. The Technical Committee believes that it inconsistent with the recreational nature of the J/105 and purposes of our class rules (e.g., "ease of handling") to permit the adjustment of standing rigging while racing. This proposal would permit the adjustment of shrouds and mast butt only in between races Ð i.e. up to the next prep gun. The penalty for violation would be a 360 degree turn.
The TC considered, but decided against, including an exception that would permit changes if the wind increases drastically after the start. The reason for this approach is the TC's belief that such an exception would likely swallow the rule and lead to controversy. In those few instances where on the course adjustment is absolutely necessary, the boat making the adjustment will run a (slight) risk of being protested, but if a protest is made, the offending boat is able to exonerate itself at a reduced penalty.

Add the following clause 5.3.16
in rule 5.3 "Permitted While
Racing":
"5.3.16 The use of a shackle or other, similar device
to attach jib or spinnaker sheets to the jib or spinnaker and to attach the
tackline to the spinnaker."
Discussion: This change is being proposed to legalize existing practice under our class rules and to expressly permit spectra "shackles" for this purpose. This proposal creates an exception from RI 02-15, which generally prohibits spectra shackles. In the TC's view, spectra is particularly well suited to replace J-locks and similar devices in these applications and do not cost significantly more.

Replace rule 3.3 with the
following:
"An Owner is a person who
legally owns 100% of the yacht or is a Group 1 competitor (as defined in US
Sailing Competitor Eligibility Appendix) who is an at least one-third partner
in terms of financial investment in the purchase of the complete yacht and the
cost of its operations. All Owners
shall be Active or Associate Members of the J/105 Class Association, provided
there shall be only one Active Member per boat."
Discussion: A
not insignificant number of J/105s are owned by partnerships of group 1 and
group 2 competitors or by "uneven" partnerships of group 1
competitors. Under current rule
3.3, boats so owned do not have an "Owner" because the
"Owner" must be one of two or three group 1s who own equal
shares. Technically read, nobody
can be the driver of such a boat under the existing rule because only
"Owners" and group 1 family members/long term shipmates of an
"Owner" can drive (see rule 3.4). This proposal would permit any group 1 who owns at least 1/3
of a boat to be an "Owner" and, therefore, drive the boat. A group 2 could own a portion of the
boat and could be part of the crew Ð but would not be an "Owner" and
could not be the driver. Also,
only family members/long-term shipmates of the group 1 "Owner" could
drive the boat under rule 3.4.
SCHEDULE
1 Ð REVISED CLASS CONSTITUTION

NAME
2.
OBJECTS
The objects of the Class are:
a) To promote the building and racing of the J/105 as a strict one-design class throughout the world.
b) To preserve J/105Õs recreational features, including ease of handling, low cost of ownership, safety and comfort.
c) To help organize and promote national and international class events for the benefit of J/105 class members ("Members").
d) To maintain the worldwide one-design integrity and equality of performance of the J/105 while maximizing participation at J/105 events.
e) To coordinate and manage the affairs and rules of the Class in cooperation with international and national sailing authorities, and J Boats, Inc, the "Copyright Holder".
3.
LANGUAGE
3.1 The official language of the Class is English and in case of any dispute over the translation the English text shall prevail.
3.2 The word ÒshallÓ is mandatory and the word ÒmayÓ is permissive.
4.
MEMBERSHIP
4.1 An
Active Member shall be a legal owner of a J/105 that complies with the Class
Rules and whose annual dues have been paid. Only Active Members are eligible to hold office.
4.2 An
Associate Member is a family member, crew or other individual supporting the
Class by paying annual dues.
4.3 Sponsoring
Members shall be those individuals, companies and corporations who provide
products and/or services to the Class or its members. The Executive Committee shall have the authority to grant
this category of membership.
5.
ANNUAL
SUBSCRIPTIONS AND FEES
5.1
The Class shall be
financed by annual subscriptions from Active and Associate Members and by
collecting other fees from Sponsoring Members and other sources. The subscription shall be determined
annually by the Executive Committee.
All Members must register annually. All subscriptions and fees shall be made payable to the
J/105 Class Association.
5.2
Subscriptions and fees
for each calendar year are due and payable to the Class on January 1, and no
person who has not paid dues for a calendar year shall be considered a Member
after March 15 of that calendar year.
6.
MEMBER SUSPENSION
6.1
A Member may be
suspended or removed from the Class by the Executive Committee for: a) Committing an unlawful act in
relation to the Class or one of its Members; b) Any unsportsmanlike conduct
contrary to the interest of the Members of the Class; or c) intentional
violation of the Class Rules.
6.2 A Member shall not be entitled to the return of any part of his Class dues in respect of any period for which he/she has been suspended or removed from membership.
7.
J/105 FLEET
7.1 A ÒFleetÓ is a local territorial unit that is self-governed in matters not conflicting with this Constitution and chartered by the Class upon application by the legal owners of three or more J/105s. A Fleet shall elect its own officers from among the boat owners which shall include at least a Fleet Captain, Secretary/Treasurer and Measurer.
7.2 A ÒVoting FleetÓ is a Fleet with at least 10 boats represented by Active Members who are members of such Fleet..
7.3 For purposes of Section 7.2 and 8.4, any Active Member who is a member of more than one Fleet shall be considered a member of only his or her declared "Home Fleet". The Home Fleet of any Active Member who has not made a declaration shall be determined by the Secretary/Treasurer.
8.
EXECUTIVE COMMITTEE; OFFICERS
8.1
The Executive Committee
(ÒExecutive CommitteeÓ)
shall consist of one Active Member appointed by each Voting Fleet (ÒFleet
RepresentativeÓ), one
representative of the Copyright Holder, one Òat largeÓ fleet representative
appointed by the Copyright Holder (the "At-Large
Representative"), the
President, the Vice-President, the Secretary/Treasurer and the Chief Measurer.
8.2 The Executive Committee shall elect annually a President, Vice-President, Secretary-Treasurer and Chief Measurer (the ÒOfficersÓ), who are not required to be Fleet Representatives.
8.3 All Fleet Representatives and Officers shall be Active Members.
8.4 Each Executive Committee member shall have one vote. In addition, each Fleet Representative shall carry one additional vote for every complete multiple of 10 boats in excess of the first 10 represented by Active Members who are registered in the fleet represented by such Fleet Representative.
8.5 For purposes of any action taken by the Executive Committee, the status of a Fleet as a Voting Fleet and the number of votes held by the Fleet Representative of each Voting Fleet shall be determined as of the date 10 days prior to the date on which the action is taken.
8.6 The President is the chief executive officer of the Class and presides at meetings, rules on procedures, and is the chief ambassador for the J/105 class at sailing related meetings and activities.
8.7 The Vice-President, in the absence or incapacitation of the President, shall preside at meetings and perform other duties as reasonably required by the Executive Committee.
8.8 The Secretary/Treasurer is responsible for sending notices of annual and special meetings, for preparing minutes of each meeting and distributing same to Executive Committee members, and for maintaining the minute book. He/She is further responsible for maintaining a bank account and the financial records of the Class, for ensuring that Members dues are current, for maintaining a current accurate database of Members, and for submitting an annual financial report and budget for Executive Committee approval.
8.9 The Chief Measurer shall be Chairman of the Technical Committee.
8.10 In the event of an Officer vacancy prior to the Annual Meeting, the Executive Committee may, in accordance with Section 9, appoint one of its remaining Executive Committee members to fill the vacancy.
8.11 The Executive Committee shall have the power to appoint other committees that shall have and may exercise such authority of the Executive Committee as it shall prescribe. The Executive Committee shall have the power to select any person or entity to assist the Officers in the exercise of their powers and duties. Any such person or entity may be paid, is not required to be a Member, but shall have no vote on the Executive Committee.
9.
EXECUTIVE COMMITTEE MEETINGS
9.1
The
Executive Committee shall hold an Annual Meeting during the fall of each year
at a location to be determined by the President and hold such Special Meetings
at such places as appropriate to efficiently carry out the business of the
Class and as may be called by the President or as decided by a previous meeting
of the Executive Committee.
9.2
The
Secretary/Treasurer shall give at least 10 days' notice of such meetings,
except if all members of the Executive Committee consent to shorter notice.
9.3
At
meetings of the Executive Committee, one-half of the members of the Executive
Committee shall be the quorum required for the conduct of business. Any change to this
Constitution shall be passed by two-thirds of the votes held by members of the
Executive Committee present or represented by proxy at the meeting. Other resolutions of the Executive
Committee shall be passed by a simple majority of the votes held by members of
the Executive Committee present or represented by proxy at the meeting.
9.4
At
its Annual Meeting, the Executive Committee shall:
a)
Elect a President,
Vice-President, Secretary/Treasurer and Chief Measurer for a term expiring at
the next Annual Meeting.
b)
Establish guidelines in
selecting the location and dates for future North American and International
Championship Regattas and their conduct.
All such regattas shall be subject to the J/105 Class Rules and interpretations
of those rules by the Technical Committee, unless otherwise approved by the
Executive Committee.
c)
Allow a member of the
Executive Committee unable to attend a meeting to assign a proxy to any other
member of the Executive Committee that is present at that meeting, so that he
or she can vote on the absent member's behalf in accordance with paragraph
8.4. This proxy must be received
by the Secretary/Treasurer prior to the meeting.
d)
Appoint the Technical
Committee.
9.5
Annual
and Special Meetings of the Executive Committee may be conducted by telephone
conference.
9.6
In
lieu of a meeting, any action of the Executive Committee may be taken by a
written resolution approved by at least a majority (or, in the case of any
change to this Constitution, at least two-thirds) of the voting members of the
Executive Committee.
10.
TECHNICAL COMMITTEE
10.1
The "Technical
Committee" shall be
appointed by, and operate as a sub-committee of the Executive Committee, with
responsibility for interpretation and enforcement of Class Rules, and
recommendations to the Executive Committee regarding Class Rules and
measurements, including suggested changes to the Class Rules.
10.2 The Technical Committee shall consist of the Chief Measurer plus one representative appointed by the Executive Committee, and one representative appointed by the Copyright Holder.
10.3 The Technical Committee shall cooperate with the Fleet measurers and licensed builders to protect the one-design character of the Class worldwide.
11.
CHANGES IN CLASS RULES
11.1
Changes to Class Rules
may be proposed to the Executive Committee by Active Members, by a licensed
builder or the Copyright Holder.
11.2
All changes shall be
proposed by September 1 for effectiveness no earlier than February 1 of the
immediately following calendar year.
11.3 Proposed changes will be first reviewed by the Technical Committee, which shall formulate a resolution for review and an initial vote by the Executive Committee.
11.4 If the Executive Committee shall approve the resolution or if the changes are proposed by at least 20 Active Members, the Executive Committee shall then provide a reasonable review period (at least 60 days) for Fleet Representatives to seek Fleet member consensus or vote prior to a final Executive Committee vote in accordance with Section 11.5.
11.5 The Committee may elect one of two methods of voting on proposed changes to the Class Rules:
a) A vote of the Executive Committee during an Annual Meeting or during any other meeting.
b) A vote of the Executive Committee members in writing after presenting the resolution/motion in writing.
11.6 Any resolution approved under section 11.5 may include amendments to the resolution submitted to the Fleets in accordance with section 11.4 which the Executive Committee determines are immaterial or non-substantive, and no additional review period under section 11.4 shall be required prior to Executive Committee vote on such amended resolution.
11.7 Changes that are approved in accordance with section 9.3 and this article 11 shall become effective (and shall apply to all Class events occurring on or after) February 1st of the year following proposal, unless the Executive Committee approves a later effective date.
12.
SPECIFICATIONS
12.1 ÒSpecificationsÓ means (i) design of hull, deck, keel, rudder, sail plan, spars, equipment, and interior of the J/105, and (ii) the manufacturing processes, techniques, hardware, equipment, furnishings and materials used in the construction of the J/105. Changes to Specifications may be proposed to the Executive Committee by Active Members. If any proposed change to the Specifications is deemed by the Technical Committee and/or the Copyright Holder to affect the speed of the yacht (a "Performance Affecting Change"), such change will require approval as a change to the Class Rules in accordance with the procedures set forth in section 11.
12.2 ÒPerformance Affecting ChangesÓ include, but are not necessarily limited to, any changes to the shape, dimensions, weight, weight distribution, and rigidity (stiffness of bending moments) of the hull, deck, interior, keel, rudder, mast and boom that, in each case, the Technical Committee determines to have more than a negligible effect on the performance, sailing charateristics and ease of operation of the J/105.
12.3 Changes to Specifications may be made by licensed builders with the prior written approval of the Copyright Holder, if such changes relate to: improving the quality of finish or interior appointments; substitution of construction materials, equipment, furnishings or hardware of equal or better quality and operation; relocation of equipment, furnishings or hardware, not otherwise restricted by Class Rules,; or revision of the molding techniques or methods of construction, provided that (a) any such change shall be designed to improve the recreational features of the J/105, including ease of handling, low cost of ownership, safety and comfort and (b) no Performance Affecting Change shall be made, and no such change shall become effective for purposes of the Class Rules (including Class Rule 1.3), unless approved pursuant to section 11.
12.4 Without limitation of clause (b) of section 12.3, no change to the Specifications pursuant to section 12.3 shall become effective for purposes of the Class Rules until 30 days' after written notice of such change to the Technical Committee, except that no prior notice shall be required for any insignificant change where the giving of prior notice would be impracticable and which the Copyright Holder determines is not a Performance Affecting Change, provided the Copyright Holder notifies the Technical Committee of such change as soon as practicable after such change is made.
13.
CHANGES TO CONSTITUTION
13.1
Changes to this
Constitution may be proposed to the Executive Committee by Active Members, by a
licensed builder or the Copyright Holder.
13.2
All changes shall be
proposed by September 1 for effectiveness on February 1 of the immediately
following calendar year.
13.3 Proposed changes shall be first reviewed and voted upon by the Executive Committee.
13.4 If the Executive Committee shall approve the changes initially, or if the changes are proposed by at least 20 Active Members, the Executive Committee shall then provide a reasonable review period (at least 60 days) for the Fleet Representatives to seek Fleet Member consensus prior to a final Executive Committee vote in accordance with section 13.5.
13.5 The Executive Committee may elect one of two methods of voting on proposed changes to this Constitution:
a) A vote of the Executive Committee during an Annual Meeting or during any other meeting.
b) A vote of the Executive Committee members in writing after presenting the resolution/motion in writing.
13.6 Any resolution approved under section 13.5 may include amendments to the resolution submitted to the Fleets in accordance with section 13.4 which the Executive Committee determines are immaterial or non-substantive, and no additional review period under section 13.4 shall be required prior to Executive Committee vote on such amended resolution.
13.7 Changes that are approved in accordance with section 9.3 and this article 13 shall become effective February 1st of the year following proposal, unless the Executive Committee approves a later effective date.
14.
FUNDS, ACCOUNTS AND EXPENSES
14.1 The funds of the Class shall be kept in a manner approved by the Executive Committee.
14.2 Books shall be kept that show assets and liabilities of the Class in addition to receipt and expenditure of monies.
14.3 The reasonable expenses of the Executive Committee members in exercising their powers under these rules shall be payable out of the funds of the Class.
15.
LIMITATIONS; INDEMNITY
15.1
To the maximum extent
permitted under applicable law, in the execution of their powers and duties
under this Constitution or under the Class Rules, no Officer or other member of
the Executive Committee (or any subcommittee thereof) shall have any liability
to any of the Members or former Members of the Class, to the Class or any other
person or entity by reason of any act or omission made in good faith by him or
her or the act or omission of any other Officer or other member of the
Executive Committee, or otherwise, other than intentional misconduct or knowing
violation of law on the part of the person who is sought to be made liable.
15.2
To the maximum extent
permitted by law, the Class shall indemnify and hold harmless each Officer or
other member of the Executive Committee (or any subcommittee thereof) of the
Class from and against any liability to any person or entity arising from acts
or omissions of such officer or member in connection with the activities of the
Class and all legal fees and expenses incurred in connection therewith,
provided that the foregoing shall not apply to acts or omissions involving
intentional misconduct or a knowing violation of law.
16.
MISCELLANEOUS
16.1 All references to "writing" herein include, and all notices, approvals and other communications hereunder may be given and made by, e-mail.
16.2 In case of any inconsistency between this Constitution and the Class Rules, this Constitution shall prevail.

EXHIBIT 7.3A
Procedure for
Equalizing Boat Weight For Class Racing
A. Install Hull Floatation Marks. Install contrasting 12mm x 75mm floatation marks on both sides of stem at the bow, and on both sides of aft end of rudder (long axis of marks parallel to waterline). The bottom of these marks shall be located as follows. Aft Floatation Mark: Locate aft hull point 170mm forward of transom along centerline of hull bottom. With the rudder fitted in its normal position, the bottom of the floatation mark shall be 60mm vertically below the aft hull point and shall be marked on both sides of the rudder at its trailing edge. Forward Floatation Mark: The bottom of the floatation mark shall be 1,260mm below the projection of the top of hull flange where it intersects the forward side of the stem head fitting measured down and around the forward face of the stem.

B. Measurement Afloat. Boat shall include only the equipment and other items specified in Paragraph C for its initial measurement. With dry bilges, boat shall be trimmed level (floatation marks approximately equidistant from the floatation plane) by temporarily relocating equipment aboard as necessary (except for equipment that may not be moved, as noted). No further equipment or ballast need be placed aboard if both the forward and aft floatation marks are touching (or are below) the surface of the water (Òproper sinkÓ).
C. Equipment and other Items Required for Measurement Trim. All equipment and other items listed in paragraph II of the J/105 Class Floatation Worksheet & Certificate, Exhibit 7.3B to the J/105 Class Association Rules (the "Class Rules") are required to be on the boat. If any optional items are permanently installed on the boat, such items may be on the boat for measurement trim, but must be listed in paragraph III of the Floatation Worksheet & Certificate and may not be removed from the locations where they are installed.
To achieve proper sink, all items referenced in this paragraph C may be located anywhere on the boat on a temporary basis (except where a required location is noted herein or in paragraph II or III of the Floatation Worksheet & Certificate); for racing, those items may be relocated from their temporary locations to any other place on the boat except as prohibited in paragraph E.2 below.
D. Trim Equalization Procedure. If the boat cannot be trimmed to proper sink with only the equipment and other items required in Paragraph C on board, the owner shall choose any combination of the following options to correct the trim to achieve proper sink:
To achieve proper sink, all items listed in subparagraphs 1, 2 and 3 of this paragraph D may be located anywhere on the boat on a temporary basis (except where a required location is noted above or in paragraph IV of the Floatation Worksheet & Certificate); for racing, those items may be relocated from their temporary locations to any other place on the boat except as prohibited in paragraph E.2 below.
E. Required Equipment & Locations:
1. All equipment, ballast (water, fuel and lead) and other items referenced in paragraphs C and D must be located on the boat at all times and, if locations are specified herein or in the Floatation Worksheet & Certificate, must be located in their specified locations.
2. While racing, except for spinnakers and the standard cooler (in its standard location), the equipment and other items referenced under Paragraphs C and D may not be located either below or on top of the main cabin flooring or the flooring of the head compartment/changing area.
F. Floatation Worksheet & Floatation Worksheet & Certificate. All items referenced under Paragraphs C and D required aboard to achieve proper sink shall be listed on a J/105 CLASS FLOATATION WORKSHEET & CERTIFICATE substantially in the form of Exhibit 7.3B to the Class Rules, with its corresponding weight, gallons and location indicated, where applicable, which shall be duly completed and signed by an Owner of the boat and co-signed by the Chief Measurer or his or her designee or any Fleet Measurer or his or her designee. A copy of such Floatation Worksheet & Certificate shall be aboard at all times while racing.
